Terms
Terms of service
Last updated: 20 May 2026
1. The service
2. Who can use it
The Service is for business use by architects, general contractors, construction firms, and related professionals. By creating an account you confirm that:
- You are using the Service in the course of your business
- You have authority to bind your firm if you sign up on its behalf
- The email address you provide is a work email you control
- You are at least 18 years old
3. Your content + your suppliers
You own all data you upload or generate via the Service — project data, supplier contacts, uploaded documents. You grant Docpass a non-exclusive licence to process this data solely to deliver the Service to you.
When you add a supplier's contact information, you confirm you are entitled to share it for the purpose of requesting project documents. We send transactional emails on your behalf (signed in your name) — your responsibility for the relationship with the supplier is unchanged.
4. Acceptable use
You agree not to:
- Upload content that's illegal, infringing, or malicious
- Use the Service to send spam or unsolicited bulk email
- Attempt to bypass authentication or rate limits
- Reverse-engineer the validation engine or scrape our curated libraries
- Resell the Service or sub-license access to others
We may suspend or terminate accounts that violate these terms, with reasonable notice where the violation isn't urgent.
5. Validation is informational
Validation results from Docpass are informational only. They do not replace independent professional review by your engineers, your Brandschutzplaner, or the Bauamt itself.
Cantonal Wegleitungen, MuKEn thresholds, and product certifications change over time. While we work to keep our rule set current and our product library accurate, we don't guarantee that a "validated" verdict means the Bauamt will accept the document. The final decision always rests with the issuing authority.
You remain responsible for the correctness of your permit submission.
6. Service availability
We aim for high availability but don't guarantee uptime on the free tier. The Service may be temporarily unavailable for maintenance, third-party outages (Supabase, Resend, Anthropic, Vercel), or causes beyond our control. Where possible we'll give advance notice of planned maintenance.
7. Fees
The free tier (1 project, 1 canton, 5 suppliers, 10 validated documents) is offered without charge. Paid tiers and their pricing will be agreed in writing before activation. We don't auto-upgrade free accounts to paid plans without your explicit consent.
8. Termination
You can delete your account at any time by emailing hello@docpass.io. On deletion we remove your data within 30 days, except where retention is required by law (e.g. accounting records).
We may terminate accounts that violate these terms, with reasonable notice where practical.
9. Limitation of liability
To the extent permitted by Swiss law, Docpass's total aggregate liability for any claim relating to the Service is limited to the fees you paid in the 12 months preceding the claim. For free-tier users, this limit is CHF 0.
We exclude liability for indirect, consequential, or special damages including lost profits, lost business opportunities, lost permit deadlines, and delay damages — except where excluded by Swiss law (e.g. intent or gross negligence).
10. Changes
We may update these terms as the product evolves. Material changes will be announced to all account holders at least 30 days before they take effect. Continued use after the effective date counts as acceptance.
11. Governing law + jurisdiction
These terms are governed by the laws of Switzerland, excluding its conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods. The exclusive place of jurisdiction is Zürich, Switzerland.
